I am on an H-1 and my wife has an H-4 visa.
We filed our I-485 in July 2007 and will be current as of July 1st 2010 as per the June 2010 visa bulletin.
We do not have an AP as we didn't renew it after the first one (from July 07) expired.
We do have valid EAD�s (which we have not used until now)
We have to travel urgently to India for some personal reasons in July 2010.
What if we get our Green Card while we are gone? Can we still enter using our valid H-1/H-4 visas/status? If not, is it mandatory to have an AP to re-enter in this case?

You will have to get your AP and enter the US using it. That would be best. Consult your lawyer too..

As MerciesOfInjustices said - thanks to the core team ! you guys are the best, I wish participants in future will refrain from using cell phones, if possible. Looks like it causes lot of static - either way the mute and un-mute option should resolve this.

If you get fired you will loose your H1 status but can definitely change your status to H4. However, you will be subjected to the cap if you want to come back on H1 unless you find a job with a non-profit org.

I was interviewed by financial client B for contract to hire postion. I already joining them on 31st March as consultant and at after 2 months end need to convert in fulltime. This job attracts me because of never thinked pay scale and benifits in my life. Company B has record that no one leave them in last 9 years. Or never they lay off anyone.
I told client B that I can work on EAD but HR Manager wants me to transfer my H1 in company B.
JOB work is not same, My AOS based on server administartor and in financial client I am goign to do desktop management.
Is this something right approch to transfer h1b? Will company A can create any problem for my GC process? I already passed 180 days for pending AOS. Another thing is my wife has already used her EAD from h1 and working as fulltime. she is my derivative applicant.

u just have restart the whole process!..but u should have an approved 140 on Eb3..!
some ppl here may think its unethical or its cheating..but i think..the PD is a measure of the who is ahead in the line...not category..;-)

I happen to hear that its more easy to convert from L1 visa to Green card .Is it something that the employer has to initiate ? Can we start the process by ourselves.

Dear All:
I am currently in my 7th year on H-1B (with I-140 approved) and my H-1B Visa expired a year ago and my current I-94 valid until next 2 years (same case for my dependants).
I am switching my employer now and my family is planning to goto India and when they go for visa stamping through my new employer - do you think they will get into the trouble because my visa (with old employer) is already expired?
And FYI - myself/my fmaily already had US Visas stamped for atleast 4-5times already in the past through various employers.
The primary applicant's H1-B status must be valid for the dependent to get H-4 VISA stamp. The primary's own VISA stamp is not an issue.

hi, first, I'm not trolling. I have a genuine question and I'm looking for answers seriously. I got laid off in 2009 while on a h1b and then for one reason or another, stayed back for 8 months. My understanding was that I could have gotten a new job within 6 months and then switched over my h1b. I was foolish. My I-94 on the h1b approval letter however had an expiration date of October 2011. By the time 8 months had gone by, I decided it was time to give up hope and return to my country.
Since I've been here, my parents have started a campaign to get me a bride. Arranged marriages are part of my culture, and people marry based on how good a match it is according to one's birthchart. If I do find a USC who is willng too marry me, will it help me in any way immigration wise? Or will my 8 months out of status stay in USA chase me for the rest of my life?

I tried a few times for scheduling infopass trying to get Boston which is closer to where I live. But I am getting Lawrence....I guess Boston office is flooded with appointments...Didn't know that Lawrence has a office too.

mate not sure about delhi in particular but people here in this forum have been stuck without visas for over a month in some places due to delay related to PIM.

What I feel is nothing wrong with this idea. Since the job market is sluggish people may be skeptical about the prospect of getting a job in this market but if you are providing some technologies that they can learn in less time and get some promising jobs they will definitely come and join. One should make sure that the candidates should be given consultation/help in getting jobs also. Here probably start with some familiar courses for less fee/no fee in the beginning and try to get some referrals and slowly try to establish it.

Yes that�s a good suggestion. We need more people than whose GC is stuck. One issue is motivating them. I was almost shocked to see the indifference of many immigrants � some of them who went through the same process very recently. I came here almost 10 years ago as a student and many of my friends got GC�s/citizenship (they had their own hassles but now its over). When I talk to them what is going on now � they simply express surprise over how/why I didn�t get it even now and forget it. But I don�t feel bad to remind them again to visit this site or something else and do something (sending faxes /talking to their employers / contributing money/ whatever they can). My point is � don�t expect an immediate action from any, even friends � especially if this does not affect them; but don�t let this discourage you. Engage them in a discussion � most of them already know the terminology like retrogession/140/485/labor etc � remind them their own process and how difficult it was and how finally there is a systematic effort to do something about it. I am sure at least some people will respond favorably.
