Hi all
I have I-140 approved from Company A . Company B applied for my H1B extn based on Company A's approved I-140 and got 3 years extension till 2011.
My question:
can I switch to company C now and get 3 more years extension again.? My I-140(company A) has not been revoked and priority date is not current.I want to start my PERM only after joining company C .

I was recently approved for an employment based GC. Along with me, my wife and < 21 daughter got too. My EB2 labor was applied in Apr 2003 when my son had just crossed 21 years of age (March 1).
When it was time to apply for our I-485s in Aug 2007, the attorney opined that because he had crossed 21 years of age at the time labor was applied, they could not file an I-1485 for him. Not knowing any better, we complied.
Talking to friends I discovered that my attorney was possibly wrong. And that I could have.....
Is my attorney's opinion correct? If not, what can I do now?

Are you serious? I must be a super expert on taxes because I have always done it on paper using a calculator for the last 14 years and counting. Just spend an hour reading the instructions and you're done. Have a question, call the IRS. Unlike other government agencies (cough.. USCIS cough..) the agents at the other end of the line are actually helpful and responsive.

Well, Not every one is as patient as you are in reading the instructions and if needed a friendly manual or dialing 800 829 1040. The feeling is mutual about the IRS helpline folks.
The OP seemed very confused and thats why I suggested not to fill in on paper by hand.

My wife is on a H4 visa. Her visa is going to expire june 2010... she has to go to India later this month on a very urgent work....
So is it advisable to go considering the scrutiny at port of entry nowadays ???

during the period from July 2009 to November 2009, your extension was pending and not rejected/denied by USCIS and also your sponsoring employer did not revoke the application. so, logically it should be authorized employment. you can work with the receipt itself, if nothing is decided about the application.
but, better talk to ur lawyer. since there is gray area for ignorant IO @ POE to misinterpret, better have your lawyer available on call during the time of your entry to explain to IO.

I am a newbie as well and have filed I-485, I-131, and I-765, and they reached USCIS by July 2nd. What happens now?:confused: I mean, I understand we will get I-485 receipt and AP and EAD and might even be called for finger printing. What after that?

After the show down of the USCIS and all the high skilled immigrats. USCIS posted that they are withdrawing the July 2nd board. This is great news.
I have filed my I-485, I-131, and I-765, and they reached USCIS by July 13th. According to the new board, USCIS will no long reject them.
So what will happen from now on? What is the procedure after this?
I guess this might be a newbie question. If someone can post some answers for me, it will be very helpful.

Sent applications to NSC on 6/29 but receipted by CSC on 8/28. Later it was transfered to NSC back. No FP notice yet. But 2 LUDs on I-485, 9/19 and 9/20. EAD and AP are approved from CSC.

I think you have to file in 2 states. Suggest you to consult a tax consultant instead of looking at the IV forums for the answer.

But now looking at my W2 it shows that my employer has been filing taxes in my previous state Missouri for the entire year. How should I go about correcting this? I was in Missouri for 5 months and in South Carolina for the remainder. In which state should I file my tax too?
Any help will be greatly appreciated

You can do it anywhere. I got my F1-H1 change of status stamping from Canada.
For first time H1B stamping, do we have to get it done in our Home country (India in my case)? Or can we get it done in Canada or Mexico?

I am in a worst scenario , just changed a job couple of months ago. I have labor and I-140 approved from Company A. I have even paid $6000 to company A to sponsor my GC and $5500 for a visa transfer. After joining company B i didn't start labor again. Begging Company A to give an employement letter , they have even cancelled my H1b visa so I can't join them back unless i pay H1b visa transfer fee and a pay-cut. Wondering if it is even worth it ?
